RE:     Cover letter

The Commission:

 The following letter is a request under Section 25 of the Police Services Act.  This request is made, as it has been explained to me that it is the only part of the Police Service Act that O.C.C.O.P.S. can deal with a request for review of a decision made by the Board members of a Police Services Board.  If this is not the case, please inform me of the proper way to request a review of a decision made by the Board members of a Police Services Board and process my request in the correct fashion.

 After I faxed off my first Nov. 29/00 letter to the Commission, I found three other letters that should be included, my Aug. 14, Aug. 15, letters and the Peel PSB Aug. 22, letter.  I have made changes to my attached Nov. 29/00, letter.

RE:     Request for The Commission to investigate, report on the activities of
            the Peel Police Services Board and to direct the Peel Police Services
            Board to undertake a reconsideration of my Oct. 10/00 complaint
            and/or such actions as the Commission sees necessary.

The Commission:

 Under Section 25 of the Police Services Act (1997), (1), The Commission may, ... or of its own motion, investigate, inquire into and report on, (a), the conduct or the performance of duties of a ... a member of a board;.  I am asking that the Commission make a motion to investigate, report on the activities of the Peel Police Services Board and/or give direction to the Peel Police Services Board, in regards to the following matter.  My Oct. 10/00 complaint against E. Kolb the Chair of the Peel Police Services Board.  I hope the Commission will direct the Peel Police Services Board reconsider my complaint and file a report, point by point, regarding the Peel Police Services Board full investigation into my complaint.  Also, the Commission, to make such recommendations to the Peel Police Services Board as the Commission see fit, to ensure that the Peel Police Services Board will not handle complaints in this fashion, in the future.

 On Oct. 10/99 I filed a formal letter of complaint with the against E. Kolb the Chair of the Peel Police Services Board (PSB), in regards to the letter he wrote dated July 7/2000.   E. Kolb was commenting on a statement I made in City of Mississauga Council June 14/2000.  That the Peel PSB didn't allow me file a complaint against Councillor N. Iannicca, who was sitting on the Peel PSB.  E. Kolb referrers to my statement in the following ways, "to unsubstantiated and unfounded allegations.", "I wish to inform City Council that there is absolutely no truth to the spurious allegations made by Mr. Barber." and "I can assure Council that Mr. Barbers charge of abuse of authority is totally contradicted by fact."  E. Kolb refers to my 1998 attempt at filing a complaint against City of Mississauga Councillor N. Iannicca.  His comments are untrue but as they were published in the City's Council agenda (Aug. 16/2000), he has put them on the public record.

 E. Kolb has publicly stated falsehoods.  The record clearly shows that I never presented the details of my complaint to the Peel PSB, (therefore I was not allowed to file a complaint), as the Peel PSB didn't forward the requested material regarding the procedure for filing a complaint with the PSB and then the PSB made a ruling without the facts of the complaint.

 The Oct. 31/00 letter from the Peel PSB (received Nov. 6/00), states "the Board finds the complaint to be without substance, and deems its review of this matter to be concluded."  There is no evidence the Peel PSB reviewed the matter/complaint in any detail.  I would point to the letters provided as proof the Peel PSB didn't allow me to file a complaint and as clear evidence that they simply dismissed my complaint (Oct. 10/00), without any real consideration, which I would call misconduct and unsatisfactory work performance.

 After I faxed off my first Nov. 29/00 letter to the Commission, I found three other letters that should be included, my Aug. 14, Aug. 15, letters and the Peel PSB Aug. 22, letter.  In my Aug. 15, letter I again ask for information on how to file a complaint against a member of the Peel PSB and in their Aug. 22, letter for the first time, they provide details of how to file a complaint with the Peel PSB.  It is very important to note this, as they were asked in 1998 for the same information and provided nothing, before dismissing my complaint.

 I am therefore asking the Commission, to (after an investigation and reporting on the activities of the Peel PSB), to direct the Peel PSB to reconsider my Oct. 10/00 complaint and the Peel PSB to file a report, point by point, regarding their full investigation into my complaint.  Also to make such recommendations to the Peel PSB as the Commission see fit to ensure that the Peel PSB will not handle complaints in this fashion in the future.

 I am also asking the Commission to consider the abuses of authority by E. Kolb and his actions that violate the Regional Municipality Peel Police Services Board, Code of Conduct, that are detailed in my original letter of complaint, items (a) to (g), dated Oct. 10/00.

RE:     The letter from the Chair E. Kolb to the City of Mississauga.

Dear Police Services Board:

 The Chair of the Police Services Board (PSB), E. Kolb, wrote a letter, dated July 7, 2000 to Arthur Grannum, Clerk of the City of Mississauga.  In it he makes a number of statements and I would like a copy of any PSB meeting (in 2000), agenda/minutes in which the subject of this letter was presented to the PSB and/or the PSB was informed that a letter was to written regarding the subject of the letter.  If there is any notes about what other members of the PSB in putted in the creation of this letter, I would like a copy of it.

Kolb the Chair of the Police Services Board, dated July 7/00.  This letter doesn't state who brought this matter to his attention and I would like you to share whatever information (including written correspondence), you have as to who and how it was brought to E. Kolb the Chair of the Police Services Board, attention.

Dear Mr. Barber:

I am in receipt of your facsimile of August 14, 2000, in which you ask for material pertaining to correspondence sent to the City of Mississauga Council by Mr. E. Kolb, Chair. I am in further receipt of your facsimile of August 15, 2000, in which you ask for information on the filing of a formal complaint against Mr. E. Kolb, Chair, for sending this correspondence.

In response to the first facsimile, the material requested is of a confidential nature.

In response to your second facsimile, I have enclosed a copy of the Code of Conduct for members of police services boards. Any complaint should be based on an alleged transgression of the Code of Conduct or legislation related to the duties and responsibilities of individual board members. For a complaint to be considered, a letter should be forwarded to the Regional Municipality of Peel Police Services Board in sufficient detail for the Board to consider the matter.

October 31, 2000    [Note this letter was mailed Nov. 1 and received Nov. 6 ]

Dear Mr. Barber:

At its meeting of October 27, 2000, the Regional Municipality of Peel Police Services Board considered your complaint against Mr. Emil Kolb, Chair of the Board.

The Board adopted the following motion:

"Pursuant to the Code of Conduct for Board members, and following a review of the material presented in correspondence dated October 10, 2000 from Mr. D Barber, the Board finds the complaint to be without substance, and deems its review of this matter to be concluded. "

[1] - I called Arthur about this and regardless of the fact the letter is addressed to him and there is mention of "quote from the video transcript", he knows nothing, nothing!  [Back]

[2] -  A reasonable request to see "who and how it was brought to E. Kolb", attention.  I wonder if he thinks, that if the public thought he was the one responsible, that in an election year they would view this it as a childish action.  My opinion, based on the fact he was not man enough to respond to my letter and that he clearly stated in Council he would look into legal action, is that, if he was in any way involved, then he has proved my point.  That he is not mature or responsible enough to hold public office and that he has abused his position on the Peel Police Services Board.     [Back]
